Website Description

  1. Charitable Purpose. Choral Arts New England (CANE) is a nonprofit, charitable organization established to promote choral music and to support choruses and choral singers throughout New England. Among the explicit goals in its Articles of Organization was “to establish a communication network, including a newsletter and chorus register, to provide information on many aspects of choral music.” CANE’s website is an important means of accomplishing its mission.
  2. No financial benefit, no outside interest. CANE receives no financial benefit, directly or indirectly, from any information provided on its website. The website does not include or accept advertising, and CANE has no relationship, financial or otherwise,  with any other entity concerning the content of CANE’s website.
  3. Nature of public website information. CANE provides many types of information freely to the public through its website. No payment of any kind is required to access that information. Public information includes:
    1. A directory of choruses (or chorus register) in the New England region.
    2. A list of auditions and similar opportunities for singers to join or otherwise get involved with New England choruses
    3. A calendar of performances and similar events in the New England region of interest to choruses and choral singers
    4. A list of summer programs in the New England region
    5. Brief “classified” announcements of news, events, and opportunities by and for the New England choral community
    6. News and announcements by CANE about its programs and operations
    7. Other information of particular interest to the New England choral community, such as general news stories and statistics
  4. Sources of website information. Most information on the CANE website is composed or compiled by CANE through its members, contractors, employees, or similar designated agents. Outside information that is compiled is obtained through examination of public records, including public websites of choral organizations, from email, web forms, or other communications, through direct contact or polling, or through other common journalistic methods.  Information that may be routinely supplied by outside parties, subject to CANE’s approval, includes:
    1. Chorus profiles to be listed in the chorus directory
    2. Auditions and similar opportunities
    3. Events to be posted on the choral calendar, together with certain promotional material (such as fliers)
    4. News, events, and opportunities to be featured as “classifieds”
  5. Copyright and ownership. All material authored by CANE or its agents is the property of CANE or its content suppliers and is protected by U.S. and international copyright laws. Any outside source submitting material for publication must certify that it has the right to use such material for the intended purpose. Those rights must include permission to use copyrighted images, graphics, icons, or similar material, as well as any recordings or other musical material contained in the submission.
  6. Conditions on submitted content.  The submitter is solely responsible for all content that they upload, post, transmit or otherwise make available on the CANE website.  In publishing such content, CANE relies on the submitter’s representations concerning the accuracy, integrity or quality of such content. By submitting content to CANE, the submitter
    1. grants permission in perpetuity to CANE to publish that material for the designated purpose, in original or edited form;
    2. recognizes that CANE has no obligation to publish the information and has the right to remove any material for any reason or for no reason;
    3. certifies that submitted content does not: contain material that infringes the intellectual property or rights or privacy of another; contain software viruses or other harmful or tracking materials; interfere with or disrupt the website or any servers or networks; or collect personal data about other users.  The submitter will indemnify and hold CANE and its officers, directors and associates harmless from and against all claims resulting from content they supply.
    4. acknowledges that CANE may retain the submitted content and may disclose contents if required by law to do so, or if it believes in good faith that it is reasonably necessary to comply with legal process, to enforce the Terms of Use, to respond to claims, or to protect the rights, property of safety of CANE, its users, or the public.
    5. recognizes that additional conditions may apply to certain types of submitted content; if so, those will be specified with the content.
  7. Accuracy of information. CANE makes every effort to ensure that all information on its website is accurate and complete. Information from outside sources is reviewed before publishing and is routinely edited for brevity and clarity. CANE takes all reasonable measures to ensure that sources of outside information are correctly identified and are not fraudulent or malicious. However, CANE cannot guarantee the accuracy, integrity or quality of any content.
  8. Remedy for inaccuracies. Upon learning of any inaccuracy or misrepresentation from whatever source CANE will promptly correct or remove the information in question.
  9. Memberships and Logins. The CANE website presently has no public user memberships or accounts. Management of the website and its material is reserved solely for CANE and its designated agents; such use by others is prohibited. Outside sources may submit information for the website through forms, email, and other methods of communication as specified by CANE, and the legitimacy of those submissions is verified by CANE through its established procedures.
  10. Conditions of use of website. The public website is that portion that is not explicitly marked as restricted or set up for access solely via login and password. Access to the non-public portion of the website is prohibited to all but authorized parties; attempting to access that area may result in banning of all access to the site from the source of such attempts. Everyone is welcome to use the public website, provided they adhere to the terms of use. In particular:
    1. You may not reproduce, distribute, transmit, display, prepare derivative works, or perform any copyrighted material on the CANE website without the prior written consent of CANE, except that you may copy and print a limited amount of content for your personal, non-commercial use only, provided that you include all copyright and other notices contained in the content and that you do not modify the content.
    2. You may not use the CANE logo or any other proprietary graphic or trademark without express written permission (permission is automatically granted for the purpose of acknowledging a grant or giving similar credit). For permission requests, email admin@choralarts-newengland.org.
    3. No portion of this site may be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose except with the express written consent of CANE. Absent such explicit consent, framing of this website is not allowed. No link or other reference to any part of the CANE website is permitted that obscures or is misleading regarding CANE’s ownership, or that portrays CANE, its associates or their products or services in a false, misleading, derogatory or otherwise offensive manner.
  11. Links to Third Party Sites. This website provides links to internet sites maintained by third parties.  CANE has no control over these sites, does not endorse the content, operators, products or services of such sites, is not responsible or liable for the content, operators, availability, accuracy, quality, advertising, products, services or other materials on or available from such sites., and shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, products or services available on or through such sites.
  12. Privacy Policy. All information collected through the CANE website is maintained in accordance with the CANE Privacy Policy. Certain forms may request personally identifiable information such as names, postal addresses, and email addresses. Web pages may include cookies and anonymized trackers to improve quality and monitor usage; none of that material yields personally identifiable information, and none is retained by CANE or used for other than the stated purposes.
